We are not an employer, staffing agency, employment services provider, recruiter, nor supervising authority of any caregivers, service providers, or clients. Our role is limited to providing a digital marketplace platform that facilitates direct connections between individuals seeking services and independent service providers. All services are provided directly between the client and the service provider, who enter into independent contractual arrangements with each other.

1. General

This privacy policy describes how we collect, use, and protect your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), the Freedom of Information and Protection of Privacy Act (Ontario), and other applicable Canadian privacy legislation. You agree to abide by these terms by accessing or using our Services.

Our servers and primary data processing operations are located within Canadian territory, ensuring compliance with Canadian data residency requirements. Any cross-border data transfers are conducted in compliance with PIPEDA and applicable provincial privacy laws.

  • You are entering into direct, independent agreements with other users, not with ComforHome.
  • ComforHome does not employ, supervise, or control any service providers.
  • Your transactions, payments, and disputes are between you and the other party, not involving ComforHome.

Changes to Terms: We may update these Terms from time to time, and we encourage you to review this page regularly. Notice of significant changes will be posted on our website at least 30 days in advance. The revised Terms will be effective immediately upon posting. These Terms are effective as of February 8, 2026.

2. Personal Information Collection

Automatic Information Collection: When you interact with our Website and Services, we automatically collect certain information from your device, such as device ID, geo-location, browsing statistics, IP address, and browser type. Information Provided by You: When you register for an account or use our services, we may collect information, including: – Your full name. – Email address. – Phone number. – Profile photo. – Professional credentials and certifications (for service providers/caregivers only). – Government-issued identification (for verification and profile creation purposes). – Police record checks and background screening documents (for caregivers only). – Resume, CV, experience, references, and other professional documents. – Service offerings and descriptions. – Any information you provide during dispute resolution or correspondence with us.

For Caregivers and Service Providers: You may submit your resume, credentials, certificates, background checks, references, and other professional documents through our online form. ComforHome will use these documents to assist you in creating your professional profile page on our platform. Your profile page will be based solely on the information and documents you provide to us, with certain privacy-sensitive details (such as home address, personal identification numbers, or other sensitive personal information) removed or masked to protect your privacy while maintaining the professional information necessary for clients to assess your qualifications.

Your Responsibility: You are responsible for ensuring that all submitted documents and information are accurate, complete, truthful, and current. You are responsible for updating your profile and submitted documents if any information changes or expires.

All such information is stored securely and processed only for the stated purposes. Data provided for verification purposes is retained only for as long as necessary and is securely deleted according to our Data Retention Schedule.

Information from Third-Party Sources: We may receive additional information about you from third parties, including demographic data, navigation data, and contact details, only with your explicit consent and only from reliable, verified sources. Such collection complies with applicable laws.

Your Privacy Matters: We are committed to protecting your personal information and its confidentiality. We appreciate your trust in us and strive to provide a secure and transparent experience for all our users. However, we do not endorse or guarantee the accuracy, currency, or authenticity of any credentials once verified. Verification serves as an indication that documents were presented and reviewed, not as an endorsement of service quality or provider reliability.
  1. Contest Administration: If you participate in any contests we organize, we will utilize your personal information to administer and manage the contests, ensuring fairness and accuracy.
  1. Legal and Regulatory Compliance: We process your information as required by applicable Canadian laws and regulations, including responses to legal requests from regulatory authorities and law enforcement.

Sharing Information with Social Media Sites and Third-Party Services:

We offer sign-on services that allow you to access our website and related platforms using your existing social media login credentials. Additionally, we provide services that enable you to share information with third-party social media websites.

When you grant us access to personal information stored on third-party websites, the extent of this access will depend on your browser settings and your explicit consent. By connecting your third-party account to your ComforHome account and granting us access to your information on these third-party platforms, you acknowledge and agree that we may collect, use, and store this information through our Privacy Policy.

Transfer of Personal Information:

We may disclose your personal information to third parties as outlined in this Privacy Policy and in compliance with applicable laws and regulations. However, without your explicit consent, we will never sell or rent your personal information to third parties for their marketing or commercial purposes.

Here is a list of parties with whom we may share your personal information:

Platform Users: When you provide contact information to other platform users (such as sharing your phone number or email with a prospective client or caregiver), ComforHome does not control that disclosure. However, all users receive a mandatory notice that platform use implies responsibility for protecting shared contact information independently.
  1. Partner Service Providers: We partner with select service providers who assist us in delivering our website Services. These include payment processors, hosting providers, marketing agencies, advertising-related service providers, and technical support. Please note that in these cases, your personal information remains under the control and responsibility of ComforHome, and all such partners are bound by confidentiality agreements. We do not share data with third parties except as necessary for the functioning of the platform and only after risk assessment.

Verification and Third-Party Verification Services: If you submit documents for verification (such as professional credentials or background checks), we may engage third-party verification providers. All such providers are contractually bound to process data solely for verification purposes and to adhere to PIPEDA standards.
  1. Google Maps and Microsoft Advertising: If you post a listing on our website, your listings or address may be displayed on a map via Google Maps. Additionally, we may provide your information to Microsoft regarding our use of Microsoft Advertising.   1. Compliance with Legal Obligations: We may share your personal information with certain third parties, such as intellectual property rights holders, supervisory authorities, tax authorities, police, and other regulatory authorities, if required by law or legal process. This may include:

Platform Limitation of Responsibility: ComforHome does not share user information with third parties for purposes of employment, hiring, supervision, or relationship management, as we are not an employer, staffing agency, or supervisor. All such relationships are formed directly between users without ComforHome’s involvement or oversight.

In our commitment to respecting your privacy and maintaining a secure website, we will not disclose your personal information to third parties unless legally required or if we believe in good faith that it is necessary to prevent potential harm, financial damages, or report alleged illegal activities.

Information you share on ComforHome:

By using our website, you acknowledge that the information you share, including advertisements, listings, and contact details, may be accessed by other users of the platform. It is essential to carefully consider how you share your personal information, as you are solely responsible for it once shared with other users. We cannot guarantee the privacy or security of the information you share with others through our platform.

Information Sharing Process: Caregiver contact information is not directly displayed to third parties on the public platform. Family users may initiate inquiries through the following methods:

  • Direct Email Inquiry: By selecting “Send email to this caregiver for direct quote,” family users provide their email address and inquiry details. When a family user uses this feature, they provide ComforHome permission to share their complete inquiry (including name, email, phone number if provided, and service requirements) with the specified caregiver. The caregiver may then respond directly to the family user’s email if interested.
  • Request Quotes via Form: Family users may submit a request for quotes using a form on our platform. The complete information provided in this form is shared with selected caregivers matching the requested services. Caregivers may then contact the family user directly.

Caregiver contact information is disclosed to family users only when the caregiver chooses to respond to an inquiry. At that point, the family user receives the caregiver’s email address as part of the caregiver’s direct reply. This ensures that caregivers maintain control over when and with whom their contact information is shared.

Caregiver Notifications on Inquiries

  1. Notification System: When a client sends inquiries to caregivers through “Send email to this caregiver for direct quote” or “Request Quotes via Form,” our website will send email reminders and SMS reminders to the caregivers selected by the client. These notifications ensure that caregivers receive timely notice of client inquiries and can respond promptly.
  1. Maintaining Current Contact Information: Caregivers should ensure that their email address and phone number are current and available on our platform. You can update this contact information at any time by editing your profile in your Account Dashboard.
  1. Managing SMS Notifications: Caregivers can reply “STOP” in any SMS message at any time to opt-out of receiving SMS reminders. If you wish to completely stop receiving email reminders, you must delete your profile through your Account Dashboard.
  1. Frequency of Notifications: The frequency of email reminders and SMS reminders depends on how many clients in the caregiver’s region submit inquiries, which is not determined by our website. The more inquiries received from clients in your region, the more notifications you may receive.

Protection of Mobile Phone Numbers and SMS Opt-in Data: We do not share, sell, or transfer mobile phone numbers or SMS opt-in consent data with third parties or affiliates for marketing or promotional purposes. Your mobile phone number and SMS preferences are used solely for the purpose of sending you service-related notifications and platform communications. Any SMS marketing or notifications you receive from us are only sent when you have explicitly opted in, and you may withdraw this consent at any time by replying “STOP” to any SMS message.

If you access our website from a shared or public computer, we strongly recommend logging off after each session. To prevent the shared computer from remembering your credentials, remember to clear cookies and browsing history.

4. Transfers of Personal Information to Other Jurisdictions:

Primary Data Processing Location: ComforHome’s primary servers and data processing operations are located in Canada. Your personal information is processed, stored, and retained within Canadian territory to ensure compliance with PIPEDA and other Canadian privacy legislation.

Limited Cross-Border Transfers: In limited circumstances, we may need to transfer personal information to recipients in jurisdictions outside Canada for specific functions (e.g., cloud backup, analytics services). In such cases, we will:

  • Ensure that any transfer is authorized by applicable Canadian privacy law.
  • Enter into contractual agreements with recipient organizations ensuring equivalent data protection.
  • Provide you advance notice of any material cross-border transfers when such notice is required by law.
  • Restrict transfers to only where necessary for legitimate operational purposes.

It’s important to note that these jurisdictions may have different data protection laws compared to Canada. In such cases, the governments, courts, law enforcement, or regulatory agencies of the foreign jurisdiction may be authorized to access your personal information as per the laws applicable in that jurisdiction. However, rest assured that when we transfer your personal information to recipients in other jurisdictions, we will uphold the same level of protection as described in this Privacy Policy.

Please note that we do not routinely operate servers in the European Union, United States, or other jurisdictions outside Canada unless explicitly authorized by law and confirmed in writing to you.

5. Marketing Purposes

By using our website, you acknowledge and consent that the information we collected may be used for marketing purposes. This includes sending you personalized or non-personalized offers related to our platform and services provided by ComforHome itself, subject to your consent preferences.

Important: Without your explicit prior consent documented in your account settings, we will not sell, rent, or share your personal information with third parties for their marketing or promotional purposes.

The right to withdraw marketing consent is easily accessible through your account settings or by following the unsubscribe link provided in all marketing communications. Upon withdrawal, we will cease marketing communications within 5 business days.

We may, however, combine your information with non-personal, anonymized data collected from other sources to enhance and personalize our services and functionalities, provided such combination does not re-identify you or violate your privacy preferences.

6. Advertising

Should you choose not to participate in our advertising personalization using your personal information or our retargeting/tracking programs, please follow the directions within the applicable advertisement and use the opt-out mechanism provided.

It’s important to note that opting out of personalized advertising does not guarantee the absence of ads. Instead, these advertisements will not be personalized through cookies, web beacons, or similar technologies. ComforHome respects your choices and ensures that your preferences are honored across all our marketing channels.

7. Data Subject Rights:

You have the following rights with respect to your personal information, in accordance with PIPEDA and applicable provincial privacy legislation:

Accessing Your Personal Information: You can contact Customer Support through Privacy – Access Information, or submitting a formal access request to our Privacy Officer. We will respond to all access requests within 45 DAYS in accordance with legal requirements. Reasonable fees may apply as permitted by law, and we will notify you of any costs in advance.

Rectifying Your Information: If your personal information is incorrect, incomplete, or irrelevant, you can request rectification by logging into your account, contacting Customer Support through Privacy-Rectify Information, or submitting a request to our Privacy Officer. We will handle such requests promptly and in compliance with applicable law and will notify affected third parties where necessary.

Changing Your Information: You can modify your personal information by logging into your ComforHome account. However, please be aware that once a classified listing is placed, changes or message deletion may not be possible if the information has been viewed or acted upon by other users. Requests for retroactive correction will be evaluated on a case-by-case basis.

Deleting Your Information: You may request deletion of all personal information associated with your ComforHome account at any time by contacting us at info@comforhome.ca from your registered email address.

Deletion Process: – Scope of Deletion: When you request deletion of your account and personal information through info@comforhome.ca, ComforHome will delete all information associated with that registered email address and account, including but not limited to: account profile, caregiver or family user profile page, submitted documents and credentials, communications and messages, inquiry history, and all associated personal data. – Timeframe: We will process your deletion request and complete the deletion within 5 business days of receiving your request. – Permanent Deletion: Once your information is deleted, it cannot be recovered. This action is final and irreversible. – Authentication: Deletion requests must be made from your registered email address to info@comforhome.ca to verify your identity. We will only delete information associated with that email address.

Important Note on Deletion Exceptions: Some information may be retained for legal or regulatory reasons, including: – Records necessary to fulfill legal obligations or resolve ongoing disputes. – Aggregated, de-identified data used for analytics and service improvement. – Information required to be retained under applicable tax or financial regulations. – Transaction records required for dispute resolution or potential litigation.

Upon deletion request, all other personal information will be securely deleted in accordance with the timeframe specified above.

Withdrawing Consent: You have the right to object, opt-out, and withdraw consent for specific uses and disclosures of your personal information at any time. To do so, please contact us through your account settings or by contacting our Privacy Officer. Please note that even if you opt-out of certain uses, we may still collect and use non-personal information regarding your website activities as necessary for platform operations.

Exceptions to Request Processing: Please be aware that certain exceptions apply to these requests. We may need to retain the information under applicable law, preserve our rights, prevent fraud or criminal activity, or keep records of your request. Additionally, information related to previously deleted ads or replies may still be retained as evidence in ongoing disputes or investigations, subject to applicable legal requirements.

  • Firewalls and Network Security: We maintain firewalls and intrusion detection systems to protect against unauthorized access.
  • Regular Security Assessments: We conduct regular security audits and penetration testing to identify and remediate vulnerabilities.

To further enhance our security practices and prevent fraud, spam, and abuse, we utilize the reCAPTCHA Enterprise tool on our website. This tool collects certain information about your hardware and software, such as device or application data, and transmits it to Google for analysis and improvement purposes. Please be aware that using reCAPTCHA Enterprise is governed by Google’s Terms of Service and Privacy Policy.

Data Retention Schedule:

We strictly adhere to legal requirements regarding the retention of personal information. Once personal information is no longer necessary for the described purposes, it is promptly and securely deleted, or de-identified where continued use is necessary. The following schedule applies:

  • Account Information: Retained for the duration of your account and 7 years following account closure for dispute resolution and legal compliance purposes.
  • Transaction Records: Retained for 7 years in accordance with applicable tax and regulatory requirements.
  • Communications: Retained for 2 years or until resolution of any dispute, whichever is longer.
  • Verification Documents: Deleted 90 days following successful verification, unless retention is required by law or if the verified information is subject to an ongoing dispute.
  • Background Check Records: Retained for 7 years, after which they are securely destroyed.
  • Cookies and Analytics Data: Retained according to cookie category and purpose (see Section 7 and Cookies Policy).

9. Other Policy

Abuse and Unsolicited Communications: We strictly prohibit the abuse of our website. You are not permitted to add ComforHome users to your mailing list, whether it be email or postal, for commercial purposes without the explicit consent of the user, even if they have made a purchase from you or connected through our platform. If you come across any instances of abuse on our website, such as spam or spoof emails, please report it to us immediately at info@comforhome.ca.

Use of Member-to-Member Communication Resources: Our member-to-member communication resources must not be used to send spam or any content that violates our Terms of Use. To ensure your security, we have automated scans in place to check for spam, viruses, phishing attempts, and other forms of malicious activity or prohibited content. Please note that we do not store messages sent through these resources permanently, unless required for dispute resolution or legal compliance.

Third Parties: This Privacy Policy applies solely to the use and transfer of information collected from you by ComforHome, unless explicitly stated otherwise. Please be aware that ComforHome has no control over the privacy policies of third parties that may be applicable to you. When we collaborate with third parties or utilize their tools to provide certain services, we will explicitly clarify which privacy policy will govern your information. We encourage you to seek clarification and ask questions before disclosing your personal information to any third party.

Responsibility for User-Shared Information: ComforHome cannot guarantee or monitor the privacy practices of other platform users. When you share your contact information or other personal details with another user, you do so at your own discretion and assume full responsibility for how that user handles your information. ComforHome is not liable for third-party misuse of information you voluntarily share with them through the platform.
