The following Terms of Service, Privacy Policy, and all policies posted on our website explicitly outline the terms on which we extend access to and authorize the use of our site, services, functionalities, features, and tools (hereinafter collectively referred to as “Website Services”). By accessing or utilizing our Website Services, you hereby pledge adherence and compliance to all the aforementioned terms and conditions.

CRITICAL INFORMATION: ComforHome is an Information Platform

ComforHome Ltd. (“ComforHome,” “we,” “us,” or “our”) is an information platform only. We are not an employer, staffing agency, employment services provider, recruiter, dispatching service, nor the supervising authority of any caregivers, service providers, or clients. Our role is limited to providing a digital marketplace platform that facilitates direct connections between individuals seeking services and independent service providers. We do not:

  • Employ or supervise any service providers.
  • Provide employment, recruitment, or staffing services.
  • Dispatch or assign care services to anyone.
  • Manage, control, or monitor the quality of services provided.
  • Enter into contracts with service providers or clients on our behalf.
  • Take responsibility for the services provided by independent service providers.
  • Guarantee the qualifications, reliability, or quality of any service provider.
  • Assume liability for relationships formed between users.

All connections, agreements, and services are directly between the client and independent service provider. By using this platform, you acknowledge and accept full responsibility for evaluating providers, negotiating terms, and managing all aspects of the relationship independently.


SECTION I: SERVICES ON COMFORHOME

This section outlines the categories of services provided on ComforHome, each with distinct service providers and corresponding responsibilities:

  1. Website Services provided by ComforHome: We provide a digital marketplace platform to enable users to:
  • Create accounts.
  • Post and manage service listings.
  • Browse available services and service providers.
  • Connect with other users.
  • Access features, functions, and tools available on the ComforHome website.
  • We use our best efforts to keep the ComforHome website operating securely and functionally. However, we do not provide the underlying personal care, household, or other services themselves; those are provided exclusively by independent service providers or clients. 
  1. Independent Service Providers: ComforHome welcomes the provision of various quality in-home care, personal support, child care, and additional living assistance services, as well as household services focusing on improving the quality of life for individuals and families. Independent service providers register and use the ComforHome Website Services to create profiles, post listings, and connect directly with clients.

In all such cases, ComforHome is only the Website Service provider and is only responsible for the functionality of its Website Services. Independent service providers are solely responsible for:

  • Holding all necessary licenses and certifications.
  • Providing services in accordance with their own professional standards.
  • Maintaining appropriate insurance coverage.
  • Quality, safety, and legality of services provided.
  • Direct contractual obligations to clients.

Please note that ComforHome explicitly defines the category and scope of services that may be posted on the platform, as described in the Terms section relevant to your role (Buyers or Providers).

Mandatory Disclaimer for All Users

By using this platform, you explicitly acknowledge and agree that:

  • ComforHome is an information platform only and does not provide, supply, guarantee, or supervise any services.
  • You are solely responsible for negotiating, documenting, and managing your service agreements.
  • All disputes, contracts, payments, and service issues are exclusively between you and the other user(s).
  • ComforHome is not liable for any loss, damage, or harm arising from services provided by independent service providers.
  • We recommend that you consider obtaining your own professional insurance to cover potential risks.

Create an Account

To utilize and enjoy certain aspects of our Website Services, registration and the creation of an account are required. You must be at least 18 years old and a resident of Canada to use the Platform. Your email address and a secure password will be needed to set up your account.

You hold sole responsibility for: – Maintaining the confidentiality of your account credentials. – All activities conducted under your account. – Immediately notifying us at info@comforhome.ca if you suspect any unauthorized use or compromise of your account.

Transferring your account to a third party without our consent is strictly prohibited.

You also have the option to connect to our Website Services through an independent third-party authentication service. By doing so, you grant us permission to access, store, and utilize the information provided by that service in accordance with their policies, as outlined in our Privacy Policy.

Engaging with the Services

  • Violate any laws or our Prohibited Listings Policy.
  • Provide false or misleading information.
  • Infringe upon any third-party rights.
  • Engage in spam, chain letters, or pyramid schemes.
  • Distribute viruses or any other harmful technologies.
  • Overload our infrastructure or disrupt the proper functioning of ComforHome.
  • Replicate, alter, or distribute other users’ content without authorization.
  • Use automated means to access ComforHome without our permission.
  • Collect information about others, including email addresses, without their explicit consent.
  • Circumvent any security measures put in place to restrict access to ComforHome.
  • Represent ComforHome’s role or your own role on the platform in any misleading manner.
  • Use language that misrepresents ComforHome as an employer, recruiter, staffing agency, or service provider.
  • Post content that violates the prohibition on “high-risk terminology” (see Section on Terminology below).

You further agree to use the Platform in accordance with all applicable Canadian laws and regulations, ensuring compliance with legal and professional standards relevant to your activities on ComforHome.

Abusing ComforHome Services

For any issues or offensive content, please contact info@comforhome.ca. We are committed to maintaining a properly functioning website. We reserve the right to:

  • Limit or terminate our Website Services.
  • Remove hosted content.
  • Take necessary technical and legal actions to address any violations of our policies.
  • Suspend or terminate your account if you:
  • Violate these Terms of Service.
  • Provide false or misleading information.
  • Engage in conduct that harms the Platform or other users.
  • Violate the Terminology Policy or other content guidelines.

We will notify you of any suspension or termination via email, with reasons provided, unless prohibited by law or urgent circumstances prevent notification. Please note that we do not accept liability for monitoring ComforHome or for any unauthorized or unlawful content found on the site. Your use of ComforHome implies your acceptance of these terms and conditions.

Global Marketplace

Please note that ComforHome reserves the right to display your listings on other classified sites in different countries besides ours. By using our Website Services, you agree to have your listings showcased on these external sites. While the terms for these sites are similar to ours, you must know that you might need to comply with additional laws or regulations specific to the country where your listing is published.

Should you choose to post your listings on another site, it is your responsibility to ensure that it aligns with the policies of that particular site. We reserve the right to remove any listings that are flagged on any of our websites or if we believe they are causing issues or violating any regulations or policies. Stay updated and in compliance with our terms for a seamless experience..

Fees

Using our Website Services is generally free, but some may come with fees. If a service you use charges a fee, you can review and accept it before proceeding. Our fees are quoted in Canadian Dollars and may change over time. Any changes to our fee policy will be communicated by posting on the website at least 30 days in advance.

We may temporarily adjust our fees for promotional events or new services, and these changes will be effective upon announcement. Please note that all fees are non-refundable and must be paid on time. Failure to do so may result in limitations to your use of the Website Services. In case of payment method failure or overdue accounts, we may employ other collection mechanisms to collect outstanding fees, including engaging third-party debt collection services.

Applicable Canadian taxes related to our Services will be collected accordingly. Please ensure you provide accurate address information to comply with relevant laws. ComforHome reserves the right, at its discretion, to determine and collect appropriate taxes if the necessary information is not provided. You are solely responsible for collecting and remitting any applicable taxes resulting from selling your services or items listed on ComforHome.

While most features of the Website Services are available across all ComforHome websites and associated mobile applications, there might be variations in certain features and functionality depending on the website or mobile device you use to access our Website Services.

To use specific functionality on our website, you must be a resident of Canada and legally capable of forming a binding contract under applicable law. This includes being of legal age in your respective Province or Territory. The ComforHome website may have additional requirements outlined in ComforHome’s other policies. Using our Website Services, you agree to comply with all relevant laws and regulations, including licensing and insurance requirements, for any sales and purchases you make from sellers on our platform.

Content

The Website Services provided on this website include content from us, you, and other users, as well as content from our service providers. By accessing and using the Website Services, you agree not to copy, modify, resell, or distribute any of the Services, including our copyrights or trademarks, without express written permission.

When you contribute content to us (including listings, descriptions, photos, or reviews), you are granting ComforHome a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to use that content and all associated rights (including copyright, publicity, and database rights) for the purposes of operating and improving the website platform.

If you believe that your intellectual property rights have been infringed upon, please contact us at info@comforhome.ca, and we will promptly investigate the matter. We reserve the right to remove any content that violates these terms or infringes upon the rights of any party without prior notice.

Reporting Intellectual Property Infringements (Verified Rights Owners – VeRO)

Do not post content that infringes the rights of third parties. This includes but is not limited to, content that infringes on intellectual property rights such as copyright and trademark. Do not post content that contains any reference to or likeness of any identifiable third parties unless consent has been obtained from each such individual as may be required.

We reserve the right to remove content where we have grounds for suspecting the violation of these terms, our policies or any party’s rights.

To report a listing that you believe infringes on your intellectual property rights:

  1. Only the intellectual property rights owner can report potentially infringing items or listings through ComforHome’s VeRO Program
  • If you have a good faith belief that a listing on any of the Services infringes your copyright, trademark, or other intellectual property rights, submit your report to info@comforhome.ca
  • After we receive your email, ComforHome will confirm receipt and investigate your report
  • We reserve the right to share relevant information with the third party that originally posted the potentially infringing listing in accordance with applicable law.

Disclaimers and Limitations of Liability

CRITICAL DISCLAIMER: Please note that our Website Services are provided “as is” and “as available.” ComforHome cannot be held responsible for the actions, conduct, or content posted by other users. Additionally, we are not responsible for services provided by independent service providers, the quality of those services, or any disputes arising therefrom.

Specific Limitations:

  1. Service Provider Independence: We are not liable for any loss, claims, or damages arising from:
  • Services provided by independent service providers.
  • The conduct or actions of any user.
  • Disputes between users.
  • Breach of contracts between users.
  • The only exception to this limitation is where such losses result from our gross negligence in verifying independent service provider credentials during registration, in which case our liability is limited to the greater of (a) the total fees paid to us in the six months before the action giving rise to liability or (b) $500 Canadian Dollars. 
  1. Payment Processing: We are not responsible for the payment processing of independent payment processors. If you link an Independent Payment Processor account to your ComforHome Account, you acknowledge and agree to be bound by their terms and conditions for payments made through ComforHome.
  1. Accuracy and Completeness: As user-generated content is prevalent on our Website Services, we do not guarantee any listings or communications’ accuracy, completeness, efficacy, timeliness, or legality. We make no representations regarding the truthfulness or reliability of any information posted by users.
  1. Service Availability: We cannot guarantee continuous or secure access to our Services. Notification functionality within our Services may experience delays beyond our control, such as delays due to geographic location or delays caused by wireless data service providers’ networks.
  1. Disclaimer of Warranties: We explicitly disclaim all warranties, representations, and conditions, express or implied, including those relating to:
  • Quality, merchantability, durability, and fitness for a specific purpose.
  • Uninterrupted or error-free service.
  • Accuracy of user-generated content.
  • Suitability of services for any particular purpose.
  • These disclaimers apply to the fullest extent legally permitted by Canadian law. 
  1. Limitation of Damages: We are not liable for any loss of money, goodwill, reputation, data, or any special, indirect, consequential, incidental, or punitive damages resulting from your use of ComforHome, even if we were advised or could reasonably foresee the possibility of such damages.

Insurance Recommendation: We strongly recommend that users consider obtaining their own professional liability insurance and background verification insurance to cover potential risks associated with services arranged through the Platform. ComforHome does not provide, arrange, or endorse any insurance coverage related to services on the platform.

Indemnification

By using the Website Services provided by ComforHome and its affiliates, you agree to indemnify and hold harmless all Indemnified Parties, including ComforHome’s officers, directors, agents, employees, and successors, from any claims made by third parties. This includes any amounts payable to the third party, whether in settlement or as a court judgment, and reasonable legal costs and attorney fees incurred by any of the Indemnified Parties.

This indemnification extends to any alleged violations of these Terms of Service or applicable laws or regulations. While we reserve the right to assume exclusive defense and control in such matters, assuming such defense does not excuse your indemnification obligations.

Personal Information and Data Processing

When utilizing our Services, you acknowledge and consent to ComforHome collecting, transferring, storing, and utilizing your personal information in accordance with our Privacy Policy. Your personal information is processed primarily on servers located in Canadian territory, in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

We collect this information to:

– Facilitate connections between clients and independent service providers.

– Improve Platform functionality and security.

– Send service-related communications.

– Ensure compliance with applicable laws.

We take reasonable measures to protect your data, but we are not liable for breaches beyond our reasonable control (e.g., sophisticated cyberattacks, acts outside our security measures). However, we will notify you promptly in the event of any confirmed data breach affecting your personal information, as required by applicable privacy laws.

General Terms

These terms and our other posted policies on the Website Services constitute the entire agreement between you and us, replacing any previous agreements. This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada that apply to it. Both parties agree to the exclusive jurisdiction of the courts in the Province of Ontario.

Your statutory rights as a consumer and specific topics governed by applicable consumer law will not be affected by these terms and will remain in full force.

Non-enforcement of any provision by us does not constitute a waiver of our right to enforce it later. If a court of competent jurisdiction strikes down any of these terms, the remaining terms will still be valid and enforceable to the fullest extent permitted by law.

We may assign this agreement at our discretion to affiliates or related entities. No notice is required for such assignment to affiliates, but we will notify you of assignment to unaffiliated third parties.

Your decision to use our platform signifies your agreement to these Terms. It’s important to note that our platform serves as an information marketplace only, connecting you with a diverse range of independent service providers to meet your varied needs.

By agreeing to these Terms, you acknowledge that:

  • ComforHome acts as an information platform facilitating connections only.
  • You are entering into direct, independent agreements with service providers, not with ComforHome.
  • ComforHome does not employ, supervise, or control any service providers.
  • The contractual agreement for services is directly between you and the independent service provider.
  • Your transactions, payments, service disputes, and employment relationships are exclusively between you and the service provider.
  • ComforHome is not liable for the quality, safety, legality, or performance of services.

We are dedicated to making your experience as seamless and positive as possible and appreciate your trust in choosing ComforHome for your service needs.

Account Creation and Responsibility

Creating an account on ComforHome is the first step in accessing our services. When you set up your account, it’s imperative that you provide information that is both accurate and current. This ensures that all transactions and communications on the platform can proceed smoothly and without any hindrances.

The security of your account is primarily your responsibility. This means safeguarding your login credentials – your username and password – to prevent unauthorized access. In a digital environment, protecting your account details is crucial for maintaining your privacy and the integrity of your transactions.

As your circumstances or details change, it’s important to keep your account information updated. Your ComforHome account is meant for your personal use. It should not be shared with others or used for any unauthorized or illegal activities. Responsible use of your account reflects a commitment to the norms and guidelines of our platform.

If you suspect any unauthorized use of your account or a security breach, it is important to contact ComforHome immediately at info@comforhome.ca. Prompt reporting helps in taking necessary actions to protect your account and prevent any potential misuse.

You have the option to terminate your account at any time you choose. However, it’s important to understand that closing your account does not negate any ongoing or completed transactions that were initiated through the platform. You remain responsible for any disputes, payments, or liabilities arising from transactions conducted prior to account closure.

ComforHome’s Right to Terminate: ComforHome reserves the right to terminate or suspend your account at any time, at our sole discretion. This action may be taken for reasons including, but not limited to: – Breach of the Terms of Service. – Engaging in prohibited activities. – Providing false or misleading information. – Any conduct deemed inappropriate or harmful to the ComforHome community. – Violation of our Terminology Policy. – Repeated abuse, spam, or harassment.

Upon termination, you may lose access to the services and content associated with your account. ComforHome is not obliged to provide a notice or explanation for the termination but may do so as a courtesy. It’s important for users to understand that adherence to our terms and policies is essential for maintaining a safe, respectful, and lawful environment on our platform.

Buyer / Client Responsibilities

It is your responsibility to:

  1. Carefully Select Services: Carefully select the services that best meet your needs. This involves reviewing the offerings of various independent service providers on our platform and making an informed decision. It is crucial for you to verify the credentials, qualifications, and reviews of the service providers to ensure they meet your standards and requirements. Making an informed choice is key to a satisfactory service experience.
  • ComforHome recommends that you request references, conduct background checks independently, and verify all qualifications before engaging a service provider. 
  1. Fulfill Your Financial Obligations: You agree to fulfill your financial obligations for the services you purchase. This means adhering to the pricing set by the service providers and the payment terms outlined by both ComforHome and the service provider. Timely and accurate payment for services not only facilitates a smooth transaction but also upholds the trust and integrity of the platform.
  1. Compliance with Laws: Ensure that your request for services and your interaction with service providers comply with all applicable laws and regulations.
  1. Written Service Agreements: ComforHome strongly recommends that you document your service agreement in writing with the service provider, which should clearly outline:
  • Scope of services.
  • Pricing and payment terms.
  • Schedule.
  • Cancellation and termination conditions.
  • Insurance and liability provisions.
  • Dispute resolution procedures.

However, ComforHome is not responsible for the content, accuracy, or enforcement of any such agreement. 

Additional Buyer / Client Responsibilities:

  • Communication: Engage in clear, respectful, and honest communication with service providers. This includes discussing service expectations, any specific requirements, and addressing queries or concerns promptly.
  • Feedback and Reviews: Provide constructive feedback or reviews for the services received. Your reviews should be honest, respectful, and helpful to both the service providers and other potential clients. False reviews are prohibited.
  • Privacy and Confidentiality: Respect the privacy and confidentiality of the service providers. This includes not sharing their personal information or any confidential details of the service transaction without consent.

By fulfilling these responsibilities, you contribute to a trustworthy and effective marketplace, ensuring a positive experience for both clients and service providers on ComforHome.

Transaction Process

When you engage a service provider through ComforHome, you are entering into a direct contractual agreement with them for the services they render. It’s important to understand that this contract is exclusively between you and the service provider. ComforHome acts merely as a facilitator in this process and is not a party to, nor responsible for, the terms and execution of this contract.

Important Information About Our Platform Role: When you submit an inquiry to a service provider through ComforHome (via “Send email to this caregiver for direct quote” or “Request Quotes via Form”), you are initiating contact with an independent service provider. By submitting an inquiry, you acknowledge that:

  • ComforHome is an information platform only.
  • You are requesting that ComforHome share your inquiry information (name, email, phone if provided, and service requirements) with the selected caregiver(s).
  • You are entering into direct contact and potential agreement with the service provider independently.
  • You are fully responsible for evaluating the service provider’s qualifications and credentials.
  • ComforHome is not liable for the service provider’s conduct, quality of work, or reliability.
  • You are responsible for negotiating all terms, pricing, and payment arrangements directly with the service provider.
  • Any disputes are between you and the service provider, not ComforHome.

It is essential for you to thoroughly review and understand the terms that any service provider proposes before committing to a contract or paying for services.

Buyer / Client Conduct

As a valued user of ComforHome, you agree to engage with service providers in a respectful and courteous manner. This commitment includes refraining from any form of abusive, discriminatory, or disrespectful behavior. Constructive and polite interactions are essential for maintaining a positive and professional environment on our platform. This respectfulness extends not only to verbal and written communications but also to any actions or behaviors during the course of service provision.

Your use of the ComforHome platform must adhere to all applicable laws and regulations. This means engaging in transactions and interactions in a manner that is lawful and compliant with legal standards. It is your responsibility to ensure that your use of the platform does not violate any laws, including those related to contract, intellectual property, privacy, and consumer rights. By adhering to these legal requirements, you contribute to a safe, reliable, and trustworthy platform for all users.

In addition to engaging in respectful interactions and lawful use of the platform, as a buyer/client on ComforHome, your conduct includes several other important aspects:

  1. Timeliness: You should honor the agreed-upon schedules for services. This includes being present at the designated time and location for services that require your presence and promptly responding to communications related to scheduling.
  • Non-Discrimination: Engage with all service providers without discrimination based on race, ethnicity, gender, sexual orientation, age, religion, disability, or other protected grounds.
  • Truthfulness in Reviews: Ensure that any reviews or feedback you provide are accurate and not malicious or defamatory.

Understanding the “Verified” Status for Service Providers on ComforHome

As a buyer/client on ComforHome, it’s important for you to understand the “Verified” status of service providers. This status indicates that a service provider has voluntarily submitted and provided supporting documentation for their relevant qualifications and credentials. These credentials may include certificates, permits, licenses, and diplomas.

What Verification Includes: – For caregivers: police record checks, CPR certificates, professional certifications – For other service providers: government ID, proof of business location, professional licenses. What Verification Does NOT Guarantee:

⚠️ Important Limitations: While ComforHome takes steps to verify documents presented, the responsibility for maintaining the authenticity and currency of their licenses and certificates lies entirely with the service providers. The “Verified” status is a voluntary process and is NOT an absolute guarantee or endorsement. It serves only as an indication that:

  • A service provider has provided certain documents for review.
  • The documents appeared to be genuine at the time of submission.
  • The information contained in those documents matched the provider’s profile at that time.

It is NOT a guarantee of: – Ongoing compliance with certification or licensing requirements – Service quality or provider reliability – Professional conduct or ethics – Insurance coverage or liability protection – Suitability for any particular role

As a Client, You Should:

  1. Consider the “Verified” status as one factor among many in your decision-making.
  • Independently verify any critical qualifications (e.g., current licenses, insurance coverage).
  • Contact the relevant professional or licensing body to confirm current status.
  • Request references and conduct your own background checks.
  • Remember that all service providers, regardless of verification status, remain fully responsible for the services they provide.

ComforHome’s Position: We want to emphasize that the “Verified” status of service providers is NOT an endorsement by ComforHome. This status simply indicates that a service provider has provided certain documentation. ComforHome does not endorse any service providers, regardless of their verification status. The decision to engage with any service provider is based solely on your judgment and discretion.

Usage Guidelines and Restrictions

As a buyer/client on ComforHome, you are bound by specific guidelines to ensure a safe and respectful experience for all users. These guidelines include:

  1. Legal Compliance: Abide by all applicable laws and avoid any activities that violate our Prohibited Listings Policy.
  1. Accuracy of Information: Provide truthful and accurate information in all interactions and transactions on the platform.
  1. Respect for Rights: Do not infringe upon the rights of third parties, including intellectual property and privacy rights.
  1. Avoidance of Malicious Activities: Refrain from engaging in spam, chain letters, pyramid schemes, or distributing harmful technologies like viruses.
  1. Infrastructure Respect: Use the ComforHome platform without overloading its infrastructure or disrupting its functionality.
  1. Content Integrity: Do not replicate, alter, or distribute content from others without proper authorization.
  1. Authorized Access: Access the platform using only authorized means and avoid automated tools or scraping without ComforHome’s explicit permission.
  1. Privacy Respect: Do not collect personal information about others without their explicit consent.

Fees

As a buyer/client using the ComforHome platform, please be aware of our fee structure and compliance requirements:

  • Fee Structure: Accessing our Website is generally free, but certain services may carry fees. If a fee is applicable to a service you wish to use, you will have the opportunity to review and accept this fee. All fees are quoted in Canadian Dollars and are subject to change. We will communicate any changes to our fee policy through our website at least 30 days in advance.
  • Payment Terms: It is important to note that all fees incurred are non-refundable and must be paid promptly as per the agreed terms. Failure to make timely payments may result in restricted access to our Website Services. In cases where payment methods fail or accounts become overdue, we may employ necessary measures to collect outstanding fees, including engaging third-party debt collection services.
  • Tax Compliance: Applicable Canadian taxes related to our services will be collected as per the law. You are responsible for providing accurate address information for tax compliance purposes. ComforHome reserves the right to determine and collect appropriate taxes if necessary information is not provided.
  • Platform Accessibility: While most features of our Website Services are available across all ComforHome websites and mobile applications, there may be variations depending on the specific website or device used.
  • Eligibility and Compliance: To utilize certain functionalities on our website, you must be a resident of Canada and legally capable of forming a binding contract under applicable law. This includes meeting the age requirement in your respective Province or Territory. Additionally, you agree to comply with all relevant laws and regulations, including those pertaining to licensing and insurance, for any transactions conducted on our platform.

Limitation of Liability

ComforHome shall not be held liable for any damages, losses, or injuries that arise from your use of the platform or from any services provided by independent service providers, except where such damages result from our gross negligence in verifying provider credentials during registration.

This includes, but is not limited to, direct, indirect, incidental, punitive, and consequential damages. ComforHome’s role is limited to facilitating the connection between buyers and service providers, and as such, we do not oversee, control, or supervise the actions, services, quality, or behaviors of these third parties.

Your decision to engage with any service provider through our platform is made at your own risk. ComforHome’s liability, if established, is capped at the greater of: – (a) the total fees paid to us in the six months prior to the claim, or – (b) no more than $500 Canadian Dollars.

We strongly recommend that clients obtain their own professional liability insurance and background verification insurance to mitigate risks associated with services.

Indemnification: You agree to indemnify and hold harmless ComforHome and its affiliates, officers, agents, and employees from any claim, suit, or action arising from or related to: – Your use of the ComforHome platform – Your violation of these Terms – Your engagement with any service provider – Any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.

Dispute Resolution

In the event of a dispute arising with a service provider, your initial step should be to attempt resolution through direct communication with them. Often, misunderstandings or issues can be resolved amicably and efficiently in this manner.

If direct resolution is unsuccessful, you may request mediation assistance. ComforHome may offer mediation assistance as a neutral party to facilitate a resolution upon your request at info@comforhome.ca. We encourage both parties to approach such situations with openness and a willingness to reach a fair and amicable resolution.

Important: ComforHome’s role in dispute resolution is to assist and guide rather than to arbitrate or provide binding resolutions. We are not obliged to resolve disputes and are not liable for their outcomes. We will not intervene in disputes regarding services, payments, quality issues, or contractual disagreements between you and service providers, as these are exclusively your responsibility to resolve.

Binding Arbitration: Disputes between you and ComforHome (not involving service providers) shall be settled through binding arbitration in Ottawa, Ontario, under the rules of the Canadian Arbitration Association.

Content Guidelines and Intellectual Property Rights

Do not post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark. Do not post content that contains any reference to or likeness of any identifiable third parties unless consent has been obtained from each such individual as may be required.

We reserve the right to remove content where we have grounds for suspecting the violation of these terms, our policies or any party’s rights.

To report a listing that you believe infringes on your intellectual property rights:

  1. Only the intellectual property rights owner can report potentially infringing items or listings through ComforHome’s VeRO Program.
  • If you have a good faith belief that a listing infringes your copyright, trademark, or other intellectual property rights, all you need to do is contact info@comforhome.ca
  • After we receive your email, ComforHome will confirm receipt and investigate your report.
  • We reserve the right to share relevant information with the third party who posted the potentially infringing listing in accordance with applicable law.

Intellectual Property of ComforHome: All intellectual property rights related to the ComforHome website and its contents, including but not limited to text, graphics, logos, images, and software, are the exclusive property of ComforHome and its licensors. This includes any modifications, adaptations, translations, or derivative works. Unauthorized use, reproduction, or distribution of any material from the ComforHome website without express permission is strictly prohibited.

Disclaimer of Warranties

You acknowledge and agree that the use of ComforHome’s Website Services, including all content, functions, materials, and information available on or accessed through our platform, is provided on an “as is” and “as available” basis.

ComforHome and its affiliates, to the fullest extent permissible by law, make no representations or warranties of any kind, express or implied, as to: – The operation of the Website Services – The information, content, materials, or products included on our platform – The accuracy or reliability of user-generated content – The quality or performance of any services offered by service providers.

ComforHome expressly disclaims all warranties, express or implied, including, but not limited to: – Implied warranties of merchantability and fitness for a particular purpose – That the Website Services, its servers, or email from ComforHome are free of viruses or other harmful components – That the use of our Website Services will be uninterrupted, timely, secure, or error-free – Any warranty as to the results that may be obtained from the use of the Website Services.

Any material downloaded or otherwise obtained through the use of the Website Services is done at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

No advice or information, whether oral or written, obtained by you from ComforHome or through the Website Services shall create any warranty not expressly stated in these Terms.

ComforHome does not endorse, warrant, or assume responsibility for any service advertised or offered by a service provider through the Website Services or any hyperlinked website or featured in any banner or other advertising.

General

As a buyer/client on ComforHome, it’s important to acknowledge that the terms set forth, along with our other posted policies, form the complete agreement between you and ComforHome, replacing any previous agreements. This agreement is governed by the laws of Ontario and the federal laws of Canada. By using our services, you agree to the jurisdiction of the courts in Ontario.

Your statutory rights as a consumer and specific topics governed by applicable consumer law will not be affected by these terms.

It’s essential to note that if we don’t enforce a provision immediately, it doesn’t mean we waive our right to do so later. Should any part of these terms be invalidated by a court, the rest remain effective.

ComforHome has the right to assign this agreement to affiliates or related entities. For non-infringement related issues, your notices to us should be sent by registered mail or email. We may update these terms, and such updates take effect upon your next use of our services or after 30 days, whichever is sooner.

These Terms of Service (“Terms”) constitute a legally binding agreement between you, the independent service provider, and ComforHome, governing your use of the ComforHome platform, website, and related services (collectively referred to as the “Platform”). By registering, accessing, or using the Platform to offer your services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

It is important to note that ComforHome serves as a facilitator and information platform only. Our role is: – To provide an online marketplace where you can create a profile and connect with potential clients – To streamline this connection through our Platform – To provide tools for direct communication between you and clients.

ComforHome’s role is NOT to: – Employ or hire you. – Supervise or control your work. – Assign clients or direct your business. – Guarantee client availability or contract volume. – Provide employment benefits, workers’ compensation, or employment insurance. – Be responsible for the services you provide or your professional conduct.

It is crucial to understand that ComforHome is not a direct provider of the services listed on the Platform and does not employ or supervise any service providers. As such, the contractual relationship established through service agreements is exclusively between you and the clients you serve.

By agreeing to these Terms, you also acknowledge that: – ComforHome is not responsible for the execution, quality, safety, or legality of the services you provide. – You are exclusively responsible for your professional qualifications, conduct, and compliance with all applicable laws. – You maintain complete control over your schedule, pricing, and service offerings. – Any disputes with clients are your responsibility to resolve. – You are responsible for maintaining appropriate insurance coverage. – You are responsible for all tax, employment insurance, and statutory obligations.

Your use of the Platform signifies your commitment to uphold high standards of professionalism, adhere to all applicable laws and regulations, and maintain the necessary qualifications and credentials for the services you offer.

Scope of Services

As an independent service provider on the ComforHome platform, you are authorized to offer a diverse array of personal and household services. Our mission is to improve access to customized services and professional service providers, focusing on improving the quality of life for individuals and families. Your role is pivotal in fulfilling this mission by providing essential services that cater to each client’s unique needs.

You have the freedom to offer various services that may include but are not limited to: – Personal care assistance for seniors, children, and individuals with disabilities. – In-home companionship services. – Home maintenance and repairs. – Lifestyle support (shopping, medication pickup, appointments). – Specialized services (hairdressing, grooming). – Household services focused on maintaining independence and comfort.

The range of services you provide should align with the ethos of ComforHome, which emphasizes convenience, comfort, and care.

It is important that all services are provided in person, allowing for a tailored and human-centric approach. This personal interaction is key to building trust and rapport with clients, ensuring that their specific needs and preferences are met with the utmost care and professionalism.

Profile Creation and Management

ComforHome provides tools to help you create and manage your professional profile on our platform. You may:

  1. Create Your Profile Directly: Build your profile by entering your professional information, qualifications, experience, and service offerings directly into your account.
  1. Submit Documents for Profile Creation: Alternatively, you may submit your resume, credentials, certificates, background checks, references, and other professional documents through our online form. ComforHome will assist you in creating your profile page based on the documents and information you provide.

Your Profile Information: Your profile page is created based solely on the documents, information, and materials you provide to us. We may remove, mask, or omit details that could unnecessarily expose your personal privacy (such as home address, personal identification numbers, or sensitive personal information) while maintaining the professional information necessary for clients to assess your qualifications and suitability.

Your Responsibilities:

  • You are solely responsible for providing accurate, complete, and current information in all submitted documents and profile details.
  • You must ensure that all credentials, licenses, certifications, references, and background information are truthful and valid.
  • You are responsible for regularly reviewing and updating your profile to ensure all information remains current and accurate.

Profile Review and Approval:

After ComforHome creates or updates your profile based on your submitted information, you will have the opportunity to review it through your account dashboard.

  • You may review, edit, and make corrections to your profile at any time through your dashboard.
  • If you identify any errors, inaccuracies, or concerns with your profile, you must report them to info@comforhome.ca within 72 hours of your profile being published.
  • Important: If you do not raise any objections within 72 hours of publication, ComforHome will consider your profile as having been reviewed, understood, and fully accepted by you. Your silence constitutes approval.
  • After the 72-hour approval window has passed, you continue to be responsible for the accuracy and truthfulness of all information in your profile.

Ongoing Profile Management:

  • You may update your profile at any time through your dashboard to reflect changes in your qualifications, availability, or service offerings.
  • You may delete your profile entirely at any time through your dashboard. Upon deletion, your profile will no longer be visible to potential clients.
  • You are responsible for removing outdated or inaccurate information from your profile immediately upon discovery.

Caregiver Notifications on Inquiries

  1. Notification System: When a client sends inquiries to caregivers through “Send email to this caregiver for direct quote” or “Request Quotes via Form,” our website will send email reminders and SMS reminders to the caregivers selected by the client. These notifications ensure that caregivers receive timely notice of client inquiries and can respond promptly.
  1. Maintaining Current Contact Information: Caregivers should ensure that their email address and phone number are current and available on our platform. You can update this contact information at any time by editing your profile in your Account Dashboard.
  1. Managing SMS Notifications: Caregivers can reply “STOP” in any SMS message at any time to opt-out of receiving SMS reminders. If you wish to completely stop receiving email reminders, you must delete your profile through your Account Dashboard.
  1. Frequency of Notifications: The frequency of email reminders and SMS reminders depends on how many clients in the caregiver’s region submit inquiries, which is not determined by our website. The more inquiries received from clients in your region, the more notifications you may receive.

Verification and Credentials

To build trust and credibility on the platform, ComforHome offers a voluntary verification process for service providers. By submitting documents for verification, you acknowledge that:

  • All documents submitted are authentic, current, and accurate.
  • You maintain the responsibility for keeping all certifications and licenses current and valid.
  • Verification is an ongoing responsibility – ComforHome cannot monitor ongoing compliance.
  • The “Verified” badge indicates only that documents were reviewed at a point in time; it does not guarantee current validity.
  • You will promptly update your profile if any certification or license expires or becomes invalid.

Documents Required for Verification May Include: – Government-issued photo ID. – Professional certificates and licenses relevant to your services. – Police record checks or background screening (for caregivers). – CPR/First Aid certification (where applicable). – Professional insurance certificates. What It Means to be “Verified”: – You have voluntarily submitted supporting documentation. – ComforHome has reviewed and validated the documents as genuine. – The information in your profile matches the documentation provided. – You have met the Platform’s verification requirements at the time of review.

What “Verified” Does NOT Mean: – ComforHome endorses your services or professional capability. – Your certifications or licenses are guaranteed to be current beyond the verification date. – ComforHome is responsible for ongoing monitoring of your compliance with professional standards. – The Platform assumes any liability for services you provide. – Clients can assume your qualifications are appropriate for their specific needs.

Your Ongoing Responsibility: You must inform ComforHome immediately if any certification, license, or credential expires, is revoked, or becomes invalid. Failure to disclose changes may result in removal of your Verified status, suspension, or termination of your account.

Prohibited Services

As an independent service provider on the ComforHome platform, it is imperative that you adhere to our standards and guidelines regarding the types of services that are not permitted. Offering any service that falls into the following categories is strictly prohibited:

  1. Illegal Services: Any service that violates local, regional, or federal laws and regulations. This includes, but is not limited to, activities that are unlawful or that promote illegal behavior.
  1. Sale of Physical Items: Selling physical goods or items is not allowed unless they are integral to and a necessary component of the service provided (e.g., parts used in home repair services).
  1. Restricted Food and Catering Services: While meal preparation services at a client’s residence are allowed, broader food and catering services, especially those requiring specific health and safety regulations beyond personal preparation, are restricted.
  1. Commercial Client Services: Our platform focuses on personal and household services for individual clients and families. Services targeted at commercial or business entities are not permitted.
  1. Adult Services: This includes any form of pornography, nudity, erotica, and related activities. Services that are sexually explicit or that exploit adults in any manner are strictly forbidden.
  1. Dating or Companionship Services with Romantic Intent: The platform is not designed for facilitating personal romantic relationships or dating services. Any service facilitating romantic encounters is not allowed. (Note: Non-romantic in-home companionship is permitted.)
  1. Substance-related Services: Services that involve the sale, distribution, promotion, or supply of alcohol, tobacco, nicotine, cannabis (marijuana), or other controlled substances are prohibited, in line with relevant laws and health guidelines.
  1. Biological Material Transactions: Any service related to the trade or transaction of blood, body fluids, body parts, including organ donation or surrogacy services, is not permitted.
  1. Child and Pet Adoption Services: The platform does not facilitate child or pet adoption services. These services require specialized legal and ethical considerations.
  1. Ticketing and Event Services: Services related to ticket sales, event planning, or event promotion are not within the scope of ComforHome’s offerings.
  1. Copyright Infringement: Offering digital products or services that infringe upon intellectual property rights, including unauthorized use or distribution of copyrighted material, is strictly prohibited.
  1. Gambling, Lotteries, and Securities Trading: Services related to gambling, lotteries, or securities trading are not permitted, as they require specific regulatory compliance.
  1. High-Risk Terminology: Your listing must not use prohibited terminology that misrepresents your role or ComforHome’s role (see Terminology Policy in General Terms section above).

Your Responsibilities as a Service Provider

As an independent service provider on ComforHome, you are solely responsible for:

  1. Compliance with All Laws: Ensuring that all services you provide comply with applicable federal, provincial, and local laws and regulations.
  1. Professional Qualifications: Maintaining all necessary licenses, certifications, and qualifications required to provide your services. You are responsible for:
  • Keeping all credentials current and valid.
  • Disclosing all expiredly immediately to ComforHome.
  • Providing proof of currency upon request.
  • Notifying clients of your qualifications and any limitations.
  1. Insurance Coverage: Obtaining and maintaining appropriate professional liability insurance and/or other coverage as required by law or prudent practice. ComforHome strongly recommends that you:
  • Carry professional liability insurance.
  • Maintain appropriate coverage for the services you provide.
  • Provide proof of insurance to clients upon request.
  • Review your insurance regularly to ensure adequate coverage.
  1. Performance Standards: Providing services in a professional, timely, and competent manner that meets or exceeds industry standards for your profession.
  1. Safety and Hygiene: Maintaining appropriate health and safety standards, including:
  • Following relevant occupational health and safety regulations.
  • Maintaining personal hygiene standards appropriate to your services.
  • Using safe techniques and equipment.
  • Reporting any injuries or incidents to clients and ComforHome.
  1. Accurate Representation: Ensuring that all information in your profile is accurate, complete, and not misleading. This includes:
  • Your qualifications and credentials.
  • Photos that genuinely represent you.
  • Descriptions of services you actually provide.
  • Honest pricing without hidden fees.
  • Your actual availability.
  1. Client Confidentiality: Protecting the privacy and confidentiality of clients, including:
  • Not sharing client information without consent.
  • Respecting client privacy in their homes.
  • Maintaining confidentiality of any sensitive information learned during service delivery.
  • Complying with privacy legislation applicable to your profession.
  1. Direct Contracts: Establishing clear, preferably written service agreements with clients that specify:
  • Services to be provided.
  • Pricing and payment terms.
  • Schedule and cancellation policies.
  • Any limitations or special conditions.
  • Insurance and liability provisions.
  1. Direct Responsibility for Disputes: You are solely responsible for:
  • Resolving disputes with clients.
  • Addressing payment disputes.
  • Handling complaints about service quality.
  • Managing contract performance issues.
  • Obtaining appropriate dispute resolution mechanisms (mediation, arbitration).
  1. Tax and Employment Obligations: You are responsible for:
  • Re Non-Transferability of Client Inquiries: mitting all applicable taxes (income tax, GST/HST where applicable).
  • Maintaining employment insurance or disability insurance coverage as appropriate.
  • Complying with all statutory obligations related to self-employment.
  • Reporting income as required by tax authorities.
  • Maintaining appropriate business records.
  1. Non-Transferability of Services and Client Inquiries:
  • You must not transfer, delegate, or reassign client inquiries to any other individual or entity without the explicit, documented consent of the client. Clients submit inquiries based on your specific professional profile, qualifications, certifications, and experience. Your profile represents only your individual professional capabilities and credentials. Transferring inquiries to others without client consent violates the client’s right to informed decision-making and breaches the client’s reasonable expectation to work with the specific service provider whose profile they reviewed. Any unauthorized transferal of inquiries may result in account suspension or termination.
  • You must personally provide all services directly to clients unless you have obtained explicit, documented consent from the client in advance. Services rendered by substitute providers, representatives, or third parties without prior client approval violate your professional obligations and client expectations. The client has contracted with you specifically based on your individual qualifications and credentials. Any unauthorized substitution of service providers may result in breach of contract claims, disputes with clients, and account suspension or termination by ComforHome.

Provider Conduct

As an independent service provider on ComforHome, you agree to:

  1. Maintain Professional Standards: Conduct yourself professionally at all times, including during interactions with clients and other users on the platform.
  1. Treat All Clients with Respect: Provide services without discrimination based on race, ethnicity, gender, sexual orientation, age, religion, disability, or other protected grounds.
  1. Be Honest and Transparent: Be truthful about your qualifications, experience, availability, and pricing. Do not misrepresent yourself or your services.
  1. Comply with All Laws: Ensure that all services provided and all business practices comply with applicable Canadian, provincial, and local laws and regulations.
  1. Respect Client Property and Privacy: Respect clients’ homes and property, and maintain confidentiality of their personal information and circumstances.
  1. Communicate Clearly: Maintain clear, professional communication with clients regarding scheduling, pricing, service details, and any issues that arise.
  1. Accept Responsibility: Take full responsibility for the quality and performance of services you provide. Do not blame ComforHome for service issues.
  1. Report Concerns: If you become aware of any safety, legal, or ethical concerns related to your work, report them to the appropriate authorities and to ComforHome where relevant.

Provider Limitations and Disclaimers

As an independent service provider, you acknowledge that:

  1. ComforHome Provides No Employment: You are an independent contractor, not an employee of ComforHome. You are responsible for all aspects of employment including:
  • Income tax deductions.
  • Employment insurance and disability insurance.
  • Workers’ compensation (if required).
  • Workplace benefits.
  • Pension planning.
  1. ComforHome Provides No Client Guarantee: We do not guarantee client availability, contract volume, or payment. Client acquisition and retention are your responsibility.
  1. ComforHome Assumes No Liability for Your Services: ComforHome is not responsible for:
  • The quality of services you provide.
  • Client satisfaction or disputes.
  • Payment disputes with clients.
  • Injuries to clients or property damage resulting from your services.
  • Violations of laws or professional standards by you.
  • Your professional conduct or reliability.
  1. You Are Solely Responsible for Disputes: Any disputes with clients regarding services, payment, quality, or conduct are your responsibility to resolve. ComforHome will not intervene in such disputes.
  1. Verification is Limited: The Verified badge does not constitute endorsement by ComforHome and does not protect you from liability. ComforHome assumes no responsibility for the accuracy or ongoing validity of verified credentials.

Fees and Collection of Personal Information

ComforHome provides its listing and matching services generally without charging providers a commission or fee. However, we may charge fees for certain premium features, promotions, or services. Any fees will be clearly communicated in advance and require your consent before charging.

For any collection of personal information from clients (such as through intake forms or payment processing), you must: – Comply with all applicable privacy laws. – Obtain appropriate consent for collection and use. – Protect personal information securely. – Not share client information with third parties without consent. – Comply with your professional obligations regarding confidentiality.

Termination of Your Account

ComforHome reserves the right to remove providers from the platform or terminate your account for:

  • Violation of these Terms of Service.
  • Violation of our Prohibited Services policy.
  • Use of high-risk terminology or policy violations.
  • Providing false or misleading information.
  • Unlawful conduct or services.
  • Professional misconduct or violations of professional standards.
  • Repeated complaints or unresolved disputes.
  • Failure to maintain current certifications or qualifications.
  • Any conduct deemed to pose a risk to clients or ComforHome’s reputation and integrity.

Upon termination, your profile will be removed and you will lose access to the platform. ComforHome will not be liable for any loss of business or income resulting from your termination.

General Terms for Service Providers

These Terms constitute the complete agreement between you and ComforHome. This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada. By using the Platform, you agree to the jurisdiction of the courts in Ontario.

Your statutory rights and obligations as a service provider are not affected by these terms.

ComforHome may update these terms at any time. Material changes will be communicated via email at least 30 days in advance. Your continued use of the Platform following the effective date constitutes acceptance of the updated terms.
