Terms of Service

These Terms of Service, together with our Privacy Policy and Cookies Policy (collectively, the Terms), govern access to and use of the website, tools, and features operated by ComforHome Ltd. at https://comforhome.ca/ (the Website Services). By accessing or using the Website Services, you agree to these Terms.


SECTION I — GENERAL TERMS (ALL USERS)

1. Who we are

ComforHome Ltd. (ComforHomeweus, or our) operates a free information platform and public directory. We help people find independent caregivers and care partners in Ontario and send inquiries to them.

ComforHome is not an employer, staffing agency, employment services provider, recruiter, dispatching service, placement agency, or the supervising authority of any caregiver, care partner, or client. We do not:

  • Employ or supervise caregivers or other independent service providers.
  • Provide employment, recruitment, or staffing services.
  • Dispatch, assign, or manage care in anyone’s home or facility.
  • Control or monitor the quality of care or other services arranged between users.
  • Enter into care contracts on anyone’s behalf.
  • Guarantee any caregiver’s qualifications, reliability, availability, or work.
  • Assume liability for relationships, payments, or disputes between users.

All connections, agreements, payments, and services are directly between the client and the independent caregiver or care partner. You are responsible for evaluating people, negotiating terms, and managing the relationship.

2. Who may use the platform as a client

Clients may be:

  • individuals;
  • households; or
  • lawfully operating care providers, facilities, or agencies that are sourcing independent caregivers or care partners.

Using the directory does not make ComforHome a staffing or dispatching agency, even when the client is an organization. Organizations remain independently responsible for their own hiring, contracting, insurance, and regulatory duties.

These Terms do not use “family users” as a user class. Marketing on the site is written for a mixed audience of individuals and organizations.

3. Website Services

ComforHome provides website functionality only. We do not provide personal care, nursing, household, or other in-home services. Those services, if any, are provided solely by independent caregivers or care partners under contracts to which ComforHome is not a party.

Website Services include, as we make them available:

  • browsing public listings, search, maps, and educational pages without an account;
  • creating and managing an account;
  • posting and managing caregiver listings;
  • sending inquiries from a listing contact form after you sign in;
  • optional paid features we describe before you buy them (for example listing promotions, and Group Inquiry if and when we launch it — see Section 8).

We use reasonable efforts to keep the site reasonably available and secure. We do not warrant uninterrupted or error-free operation.

Independent caregivers and care partners are solely responsible for:

  • complying with applicable law;
  • holding licences and certificates required for the work they offer;
  • their own professional standards, insurance, and tax obligations;
  • the quality, safety, and legality of services they provide;
  • their contracts with clients.

4. Mandatory acknowledgements

By using the Website Services you acknowledge and agree that:

  • ComforHome is an information platform and public directory only.
  • You are solely responsible for negotiating, documenting, and managing any service agreement.
  • Disputes, contracts, payments, and service issues are exclusively between you and the other user(s).
  • ComforHome is not liable for loss, damage, or harm arising from services provided by independent caregivers or care partners.
  • You should consider obtaining insurance appropriate to your role (client or care partner).

5. Browsing versus accounts

You may browse public pages — including the home page, directory, individual listings, and How To pages — without creating an account.

You must have an account to:

  • create, edit, or manage a listing or dashboard;
  • send a message or quote request from a listing contact form;
  • purchase optional paid Website Services, if offered.

Account holders must be at least 18 years old, residents of Canada, and legally able to form a binding contract under the law of their province or territory. Those limits apply to account holders (including people who send inquiries or post listings). They do not apply to people who only read public pages.

We do not offer sign-in through third-party social networks or other identity providers. Accounts are created with an email address and password (or other methods we display on the sign-in page). Footer links to Facebook, X (Twitter), or LinkedIn are public pages, not login.

You are responsible for keeping your credentials confidential, for activity under your account, and for telling us at info@comforhome.ca if you suspect unauthorized use. You may not transfer your account without our consent. Information you provide must be accurate and kept current.

6. Messaging caregivers

Public listings may be read by guests and by search engines. Caregiver phone numbers and email addresses are not shown on the public listing by default.

To send a message from a listing contact form you must sign in. Guests may see the form; submitting it requires an account. After you sign in, we may restore a draft stored only in your browser (see the Privacy Policy).

By submitting a listing contact form you authorize ComforHome to send the contents of that form (including name, email, phone number if you provide one, and your message) to the caregiver for that listing, so they may reply to you directly.

To reduce abuse, each account may contact a limited number of distinct listing profiles per calendar day. The current default limit is 20 unique profiles per day. Contacting the same profile again on the same day does not use an extra slot. We may change the limit. If you reach the limit, further new-profile messages will fail until the next calendar day.

When a client sends an inquiry, we notify the selected caregiver by email and SMS. Keep your email and mobile number current in your dashboard. You may reply STOP to SMS notifications. To stop email notifications related to your listing, delete the listing or close your account as described in your dashboard, or contact info@comforhome.ca.

The caregiver’s own email or phone is typically disclosed to you only if they choose to reply.

7. CERTIFIED badge

The CERTIFIED badge means that, at the time of review, the Ontario credentials required for that listing type were submitted and are on file with ComforHome. It is a display standard for search and comparison.

CERTIFIED is not:

  • a representation that documents are authentic, current, or sufficient for a particular engagement;
  • an endorsement of the caregiver or of any service;
  • ongoing monitoring of licences or practice;
  • a substitute for inspecting original documents in person or checking the relevant college or issuer yourself.

ComforHome does not look up public registers (including CNO, CPO, or COTO) on your behalf. ComforHome does not warrant certificate authenticity. A police record check or similar document on file is not a background check performed by ComforHome for a client. Clients who want a current check should request it from the caregiver.

If a credential expires, is revoked, or otherwise ceases to be valid, the care partner must update their profile immediately. We may remove the CERTIFIED badge, suspend the listing, or close the account.

8. Fees

A. Care and service fees between users. ComforHome does not set, collect, or take a commission on amounts clients pay caregivers. Payment methods (for example e-transfer) are arranged directly between users. We do not process those payments. There is no public Payment Methods policy page.

B. Optional fees for Website Services. Browsing listings and sending listing-form inquiries as described in Section 6 is free of platform commission. We may charge for optional features, including:

  • optional listing promotions or featured placement, if offered on the site at the time, in Canadian dollars, shown for you to accept before you pay;
  • Group Inquiry, a future (phase two) paid feature. It is not currently available on the public site. When we launch it, it will be offered to signed-in users for a fee we will display before purchase, and will allow one request to be sent to multiple caregivers you select.

If we charge a Website Services fee, you can review and accept it before proceeding. Fee changes for Website Services will be posted at least 30 days in advance, except temporary promotions, which may take effect when announced. Website Services fees, if any, are quoted in Canadian dollars. Applicable taxes may be added. Unpaid optional fees may result in loss of the paid feature.

We may use a payment processor only for optional Website Services fees you choose to buy — not for care wages between users.

9. Public display of listings

By posting a listing you grant ComforHome a non-exclusive, worldwide, royalty-free licence to host, display, index, and reproduce that listing (including text, photos, and credentials you choose to show) on comforhome.ca, in search engine results, and in our own advertising of the directory. We do not syndicate listings onto unrelated classified websites in other countries.

Anything you put in the public profile (including a phone number or email you type into the visible description) can be seen by visitors and crawlers. Do not put government ID numbers, home addresses, or other sensitive data in public fields.

10. Acceptable use

You agree not to:

  • violate any law or our prohibited listings rules;
  • provide false or misleading information;
  • infringe others’ rights;
  • spam, scrape without permission, overload the site, or circumvent security;
  • collect others’ contact details except through the intended inquiry tools;
  • misrepresent ComforHome as an employer, recruiter, staffing agency, dispatcher, or care provider;
  • use high-risk terminology, including claiming you are a ComforHome employee, that “we dispatch” or “we hire for you,” or that CERTIFIED is a government licence or a guarantee of authenticity.

11. Abuse, suspension, and closing an account

Report abuse to info@comforhome.ca. We may limit or end Website Services, remove content, and suspend or close accounts for breach, fraud, harm to other users, or high-risk terminology.

We will usually email you if we suspend or close an account, unless the law or urgent circumstances prevent notice. We do not accept liability for failing to monitor all content. Closing your account does not cancel obligations already incurred between you and other users.

12. Content and intellectual property

Do not copy, modify, or distribute the Website Services, our trademarks, or other users’ content without permission.

If you submit content (listings, photos, descriptions, or reviews), you grant ComforHome a non-exclusive, worldwide, perpetual, royalty-free, sub-licensable right to use that content to operate and improve the Website Services.

Reporting Intellectual Property Infringements (Verified Rights Owners — VeRO). Only the rights owner may report alleged infringement. Email info@comforhome.ca with a good-faith description of the work and the listing. We may notify the poster as permitted by law. “Verified Rights Owners” is the name of this reporting process; it is not the CERTIFIED badge.

13. Disclaimers and limitation of liability

Website Services are provided as is and as available. ComforHome is not responsible for other users’ conduct, listings, or care.

We are not liable for loss, claims, or damages arising from services provided by independent caregivers, user conduct, disputes between users, or breach of contracts between users.

Receiving documents for the CERTIFIED display standard is not a warranty of authenticity, currency, or fitness, and does not create a duty to verify credentials with colleges or issuers.

We do not guarantee accuracy, completeness, or legality of user-generated content, or continuous access. Notifications (email or SMS) may be delayed.

To the fullest extent permitted by Canadian law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for loss of money, goodwill, reputation, or data, or for special, indirect, consequential, incidental, or punitive damages, even if foreseeable.

If liability is nevertheless established, it is capped at the greater of (a) the total Website Services fees you paid us in the six months before the claim, or (b) CAD $500. Amounts paid between clients and caregivers are not “fees paid to us.”

These limits do not exclude liability that cannot be excluded under applicable law (including fraud or certain consumer rights).

We recommend that users obtain insurance appropriate to their activities. ComforHome does not provide or endorse insurance.

14. Indemnification

You agree to indemnify and hold harmless ComforHome and its officers, directors, agents, employees, and successors from third-party claims, including settlements, judgments, and reasonable legal fees, arising from your use of the Website Services, your content, your dealings with other users, or your breach of these Terms or of law. We may assume defence without waiving your indemnity.

15. Personal information

We collect, use, and disclose personal information as described in the Privacy Policy. Primary processing is in Canada, subject to PIPEDA and limited transfers described there.

16. General

These Terms and the posted policies are the entire agreement between you and us. They are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. You agree to the exclusive jurisdiction of the courts of Ontario, except that disputes between you and ComforHome (not disputes between users about care) may be referred to binding arbitration in Ottawa, Ontario, under the rules of the Canadian Arbitration Association.

Statutory consumer rights that cannot be waived remain in force.

Failure to enforce a provision is not a waiver. If a provision is invalid, the rest remains in effect.

We may assign these Terms to an affiliate without notice, and to an unaffiliated party with notice.

Notices to us (other than illegal-content reports) must be sent by registered mail or email to ComforHome Ltd., info@comforhome.ca. We may notify you at your account email. Email is deemed received on transmission; registered mail five business days after posting.

Changes. We may update these Terms. We will give at least 30 days’ notice of material changes by email (where we have an address) and a prominent site notice. Continued use after the effective date is acceptance.


SECTION II — TERMS FOR CLIENTS

This Section applies if you use the Website Services to find or contact caregivers or care partners. Section I applies as well.

You acknowledge that ComforHome only facilitates information and inquiries. Any care contract is solely between you and the independent caregiver. ComforHome is not liable for quality, safety, legality, or performance of their work.

17. Your responsibilities as a client

You are responsible for:

  1. Selecting with care. Review listings, credentials, and reviews. Independently verify qualifications, request references, inspect original documents, and, where relevant, confirm registration with the applicable college. Do not treat CERTIFIED as a substitute for that work.
  2. Paying the caregiver. Honour the price and payment terms you agree with them. ComforHome does not process those payments and is not a party to them.
  3. Lawful requests. Your requests and arrangements must comply with applicable law.
  4. Written agreements. We strongly recommend a written agreement covering scope, rate, schedule, cancellation, insurance, and dispute resolution. ComforHome does not draft, approve, or enforce that agreement.

Also:

  • Communicate clearly and respectfully.
  • Reviews: If you submit a review or other public feedback, it must be honest, respectful, and not defamatory. False reviews are prohibited. You should consider available reviews when choosing a caregiver.
  • Do not share a caregiver’s personal information without consent.

18. Before you hire

Meet in person or by video before relying on someone in a home or facility. Ask to see original certificates and government ID. For nurses, physiotherapists, and occupational therapists, confirm status on the public register yourself. Check First Aid / CPR expiry dates. Agree in writing on duties, schedule, rate, and roles. Published hourly ranges on the site are caregiver-stated examples only; the rate you pay is the one you agree.

A document on file for CERTIFIED is not a ComforHome background check. Request current screening from the caregiver if you need it.

19. Inquiries

Submitting a listing contact form asks us to share your inquiry with that caregiver. You are responsible for evaluating them and for all terms, pricing, and payment. Disputes about care are between you and them.

Group Inquiry, when launched as a paid phase-two feature, will similarly share one request with multiple caregivers you select, on the terms shown at purchase.

20. Conduct

Engage respectfully and without discrimination based on protected grounds under applicable human rights law. Honour agreed schedules. Reviews you post must be truthful.

Account rules in Section I apply. Your account is for your own use (including use on behalf of an organization you are authorized to represent). Do not share login credentials.

21. Disputes between you and a caregiver

Try to resolve issues directly. You may ask ComforHome at info@comforhome.ca for informal help. We are not obliged to mediate, arbitrate, or decide care, payment, or quality disputes, and we are not liable for outcomes.

Disputes between you and ComforHome are handled under Section 16.


SECTION III — TERMS FOR CAREGIVERS AND CARE PARTNERS

This Section applies if you list services or receive inquiries as an independent caregiver or care partner. Section I applies as well.

You are an independent contractor, not an employee of ComforHome. We do not hire you, supervise you, assign clients, guarantee volume or payment, or provide employment benefits, workers’ compensation, or EI as your employer.

You are solely responsible for the services you provide, your qualifications, your conduct, insurance, taxes, and disputes with clients.

22. Scope of listings

You may offer in-home care and household support consistent with your lawful qualifications — for example personal support, companionship, and related household help — to clients described in Section 2.

Services should be provided in person unless you and the client clearly agree otherwise in writing.

23. Profile

You may build a profile in your dashboard or submit documents so we can help assemble a public page. The public page is based on what you provide. We may mask home addresses, ID numbers, and similar sensitive data.

You must keep the profile accurate. Review a newly published profile promptly and tell us of errors within 72 hours of publication; after that window we treat the profile as accepted by you, without reducing your ongoing duty to keep it true.

Public listings are visible to guests and search engines. Do not put private contact details in public fields if you want them disclosed only when you reply to an inquiry.

24. Notifications

When a client sends an inquiry, we notify you by email and SMS. Keep those details current. Reply STOP to SMS to opt out of SMS. Frequency depends on how many inquiries you receive.

25. CERTIFIED documents

Submitting documents for CERTIFIED is voluntary. You warrant that they are authentic, current, and accurate. ComforHome files them for the display standard described in Section 7; we do not warrant authenticity to clients.

Documents may include government photo ID, professional certificates or licences, police record checks, CPR/First Aid, and insurance certificates, as requested for your listing type. Sensitive documents are not published in full on the public profile.

You must tell us immediately if a credential expires or is revoked. We may remove CERTIFIED status or close the account.

26. Prohibited listings

You may not offer:

  1. Illegal services.
  2. Sale of physical goods except as incidental to a permitted service.
  3. Catering or food service beyond ordinary in-home meal preparation.
  4. Adult, sexual, or sexually exploitative services.
  5. Dating or romantic companionship (non-romantic in-home companionship is allowed).
  6. Sale or supply of alcohol, tobacco, cannabis, or other controlled substances.
  7. Trade in biological material, organs, or surrogacy brokerage.
  8. Child or pet adoption services.
  9. Ticketing or event promotion as a listing type.
  10. Copyright-infringing digital goods.
  11. Gambling, lotteries, or securities trading.
  12. High-risk terminology (Section 10).
  13. Using the directory as a wholesale marketplace for unrelated commercial goods, or transferring client inquiries to another person or entity without the client’s documented consent.

You may receive inquiries from, and contract with, individuals, households, and lawfully operating care providers, facilities, or agencies. That is permitted client use, not a “commercial goods” listing.

27. Your duties

You are responsible for legal compliance; current qualifications; insurance; professional performance; safety; honest profiles and pricing; client confidentiality; preferably written contracts; resolving disputes with clients; and tax and self-employment obligations.

You must personally provide the services unless the client has agreed in writing to a substitute. Unauthorized substitution or inquiry-transfer may lead to suspension.

Do not treat ComforHome as your employer or blame ComforHome for service issues between you and a client.

28. Conduct

Maintain professional standards. Do not discriminate on protected grounds. Be honest about qualifications, rates, and availability. Respect client property and privacy.

29. Limits

We do not guarantee clients or payment. We are not liable for your services, injuries, property damage, or professional misconduct. CERTIFIED does not protect you from liability.

Optional Website Services fees (promotions; Group Inquiry when launched) are as in Section 8. Listing without those extras does not include a commission on care wages.

If you collect personal information from clients yourself, you must comply with privacy law. Do not add ComforHome users to marketing lists without their consent.

30. Termination

We may remove listings or close accounts for breach, prohibited services, false information, unlawful or unprofessional conduct, failure to keep credentials current, or risk to others or to the integrity of the directory. We are not liable for lost business after termination.
