These Terms of Service (“Terms”) constitute a legally binding agreement between you, the third-party service provider, and Comforhome, governing your use of the Comforhome platform, website, and related services (collectively referred to as the “Platform”). By registering, accessing, or using the Platform to offer your services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

It is important to note that Comforhome serves as a facilitator, providing an online platform where you, as an independent service provider, can connect with potential clients. Our role is to streamline this connection through our Platform, thereby enhancing accessibility and convenience for both service providers and clients. However, it is crucial to understand that Comforhome is not a direct provider of the services listed on the Platform and does not employ or endorse any service providers. As such, the contractual relationship established through service agreements is exclusively between you and the clients you serve.

By agreeing to these Terms, you also acknowledge that Comforhome is not responsible for the execution, quality, safety, or legality of the services provided, the accuracy of listings, or the ability of service providers to deliver services as promised. Your use of the Platform signifies your commitment to uphold high standards of professionalism, adhere to all applicable laws and regulations, and maintain the necessary qualifications and credentials for the services you offer.

As a third-party service provider on Comforhome, you have the unique opportunity to contribute to the well-being and comfort of individuals in need of personal and household assistance. We encourage you to leverage this platform to build a positive reputation, foster trust with clients, and grow your professional service offerings.

Scope of Services

As a third-party service provider on the Comforhome platform, you are authorized to offer a diverse array of personal and household services. Our mission is to improve access to customized services and professional service providers, focusing on improving the quality of life for individuals and families. Your role is pivotal in fulfilling this mission by providing essential services that cater to each client’s unique needs.

You have the freedom to offer various services that may include but are not limited to, personal care assistance, home maintenance, lifestyle support, and other specialized services. The range of services you provide should align with the ethos of Comforhome, which emphasizes convenience, comfort, and care. This may encompass services like hairdressing, personal grooming, home repairs, gardening, shopping assistance, medication pick-ups, and more, all aimed at assisting individuals in their daily lives.

It is important that all services are provided in person, allowing for a tailored and human-centric approach. This personal interaction is key to building trust and rapport with clients, ensuring that their specific needs and preferences are met with the utmost care and professionalism.

Prohibited Services

As a third-party service provider on the Comforhome platform, it is imperative that you adhere to our standards and guidelines regarding the types of services that are not permitted. Offering any service that falls into the following categories is strictly prohibited:

  1. Illegal Services: Any service that violates local, regional, or federal laws and regulations. This includes, but is not limited to, activities that are unlawful or that promote illegal behavior.
  2. Sale of Physical Items: Selling physical goods or items is not allowed unless they are integral to and a necessary component of the service provided (e.g., parts used in home repair services).
  3. Restricted Food and Catering Services: While meal preparation services at a client’s residence are allowed, broader food and catering services, especially those requiring specific health and safety regulations, are restricted.
  4. Commercial Client Services: Our platform focuses on personal and household services for individual clients and families. Services targeted at commercial or business entities are not permitted.
  5. Adult Services: This includes any form of pornography, nudity, erotica, and related activities. Services that are sexually explicit or that exploit adults in any manner are strictly forbidden.
  6. Dating Services: The platform is not designed for personal relationships or dating services. Any service facilitating romantic encounters or relationships is not allowed.
  7. Substance-related Services: Services that involve the sale, distribution, or promotion of alcohol, tobacco, nicotine, and marijuana are prohibited, in line with relevant laws and health guidelines.
  8. Biological Material Transactions: Any service related to the trade or transaction of blood, body fluids, body parts, including organ donation or surrogacy services, is not permitted.
  9. Child and Pet Adoption Services: The platform does not facilitate child or pet adoption services. These services require specialized legal and ethical considerations.
  10. Ticketing and Event Services: Services related to ticket sales, event planning, or event promotion are not within the scope of Comforhome’s offerings.
  11. Copyright Infringement: Offering digital products or services that infringe upon intellectual property rights, including unauthorized use or distribution of copyrighted material, is strictly prohibited.
  12. Lottery and Securities Trading: Services related to gambling, lotteries, or securities trading are not permitted, as they require specific regulatory compliance.
  13. Offensive or Harmful Services: Any service that is deemed offensive, harmful, or detrimental to the well-being and safety of individuals or the general public is strictly forbidden.

Account Creation and Responsibility

As a service provider on the Comforhome platform, you are required to create and maintain an account to offer your services. It is your responsibility to provide accurate, complete, and current information during the registration process and to update this information as necessary to ensure its ongoing accuracy. The security of your account, including the confidentiality of your username and password, rests solely with you. You agree to notify Comforhome immediately of any unauthorized use of your account or any other breach of security.

Your account is for your professional use only and is not to be shared with or transferred to any other individual or entity. You agree to use your account in compliance with all applicable laws, regulations, and these Terms of Service. Any misuse, fraudulent activity, or unethical conduct associated with your account may result in suspension or termination of your account and access to the Comforhome platform.

Through your account, you have the ability to list and describe the services you offer, set pricing, and manage bookings and client interactions. You are expected to represent your services accurately and professionally, avoiding any false or misleading information. Interactions with clients through the platform should be conducted in a respectful and professional manner at all times.

Your account will feature a review and feedback system, allowing clients to rate and review the services you provide. While you cannot control the content of these reviews, you have the right to report any review that you believe to be false or defamatory. However, Comforhome does not guarantee the removal of any review unless it clearly violates our platform policies.

You are expected to adhere to all platform policies and guidelines as set forth by Comforhome, including those related to service provision, client interactions, and account management. Failure to comply with these policies may result in disciplinary action, up to and including account termination.

You may choose to terminate your account at any time by notifying Comforhome in writing. Upon termination, any outstanding obligations or agreements between you and clients facilitated through the Comforhome platform must be fulfilled or appropriately resolved. Comforhome also reserves the right to terminate or suspend your account at its sole discretion for any breach of these Terms or applicable laws.

Your use of the Comforhome platform and any personal data provided through your account is subject to our Privacy Policy. You consent to the collection, use, and sharing of this data in accordance with the Privacy Policy, including for purposes of service improvement, platform analytics, and as required by law.

Verification Process

The “Verified” status on the Comforhome platform is a designation that indicates a higher level of credibility and trustworthiness for service providers, including Caregivers, Care Providers, and Third-Party Service Providers. Achieving this status means that you, as a service provider, have provided evidence of your qualifications and compliance with relevant standards.

To be eligible for the “Verified” status, you must submit evidence of your professional qualifications. This includes:

  1. For caregivers and care providers:
    • A valid Police Record Check or Vulnerable Record Check.
    • CPR/AED certificate.
    • Copies of relevant certificates, permits, licenses, and diplomas.
    • Professional resumes and references.
  2. For third-party service providers:
    • A government identification card or utility bill (e.g., electronic/gas) confirming your name and address.
    • A valid police record check or student ID card, particularly if providing indoor services.
    • If operating from a business location, proof of the business address.
    • Copies of any relevant professional certifications, permits, licenses, and diplomas.

Opting for the “Verified” status is entirely voluntary. However, achieving this status can enhance your visibility and credibility on the platform. You are responsible for the authenticity and ongoing validity of all submitted documents. Any updates to your credentials must be promptly communicated to Comforhome.

Upon submission, your documents will be reviewed for validity and authenticity. This process includes checks for signs of forgery or tampering. The verification does not involve further investigation or auditing by Comforhome, but relies on the accuracy and truthfulness of the information you provide.

Please note that being “Verified” is an indication of your claimed qualifications and does not transfer any liability associated with your services to Comforhome. You remain solely responsible and fully liable for all services you provide, including adherence to professional standards and regulatory compliance.

To maintain your “Verified” status, you must ensure that all required documents and credentials are kept up to date. Comforhome reserves the right to periodically review your status and request updated documentation as necessary.

Usage Guidelines and Restrictions

As a valued service provider on the Comforhome platform, it is crucial that you adhere to specific guidelines and legal requirements to maintain a safe, trustworthy, and valuable experience for all users. By using the Comforhome platform, you agree to the following:

  1. Adherence to Laws and Prohibited Listings Policy:
    • You must not violate any local, regional, or national laws, regulations, or ordinances.
    • You must adhere to our Prohibited Listings Policy, avoiding offering any services that are not permitted on the platform.
  2. Accuracy of Information:
    • Provide accurate and truthful information about your services, qualifications, and any other content you post.
    • Avoid providing misleading or deceptive information that could misrepresent your services or intentions.
  3. Respect for Third-Party Rights:
    • Ensure that your use of the platform does not infringe upon the rights of others, including intellectual property, privacy, or any other personal or proprietary rights.
  4. No Spam or Fraudulent Schemes:
    • Refrain from engaging in spamming activities, sending chain letters, or participating in pyramid or similar schemes.
    • Do not use the platform for fraudulent activities or scams.
  5. No Distribution of Harmful Technologies:
    • Avoid distributing viruses or any other harmful code or technology that may damage or interfere with the operation of the platform or harm other users.
  6. Infrastructure Integrity:
    • Do not take actions that would overload or unduly burden our platform’s infrastructure.
    • Avoid any activities that could disrupt the proper functioning of Comforhome or impair the use of the platform by other users.
  7. Content Use and Intellectual Property:
    • Refrain from replicating, altering, or distributing content from another person without their express permission.
    • Respect the intellectual property rights of others at all times.
  8. Prohibited Automated Access:
    • Do not use automated means, including robots, spiders, scrapers, or similar technologies to access the Comforhome platform without our explicit permission.
  9. Privacy and Information Collection:
    • Collect personal information about other users, including email addresses, only with their explicit consent and in compliance with applicable data protection laws.
    • Respect the privacy and confidentiality of information you may obtain through your use of the platform.
  10. Circumvention of Security Measures:
    • Avoid circumventing or attempting to breach any security measures we have implemented to restrict access to or use of the Comforhome platform.

Failure to adhere to these guidelines may result in actions against your account, including suspension or termination of your access to the Comforhome platform, and legal action where necessary. We take these guidelines seriously to ensure the safety and integrity of our platform for all users.

Cross-Posting of Listings on External Classified Sites

By engaging with Comforhome and using our Website Services, you grant Comforhome the right to display and showcase your service listings on other classified sites beyond our primary platform. This is part of our effort to enhance the visibility and reach of your services to a broader audience, potentially spanning different countries.

While we endeavor to partner with external sites that have similar terms and conditions to ours, you acknowledge that there may be variations. It is your responsibility to familiarize yourself with and adhere to the terms and conditions of these external sites when your listings are posted there. Additionally, when your listings are displayed in other countries, they may be subject to the laws and regulations specific to those jurisdictions. You are responsible for ensuring that your listings comply with all applicable local laws and regulations of the countries where they are published.

If you choose to actively post your listings on another site, whether affiliated with Comforhome or not, you must ensure that your listings align with the policies and guidelines of that particular site. This includes respecting any local laws and cultural norms that may apply.

Comforhome reserves the right to monitor the performance and reception of your listings on our platform and the external sites where they are cross-posted. We reserve the right to remove any listings from our platform and affiliated sites if they are flagged for inappropriate content, cause issues, or are found to be in violation of any regulations, laws, or policies.

As a service provider, you are encouraged to stay updated with the terms and conditions of Comforhome and any external sites where your listings may appear. Ensuring compliance with these terms is crucial for a seamless and uninterrupted experience on our platform and its affiliates.

Fees and Payment Terms for Using Website Services

While the general use of our Website Services is complimentary, certain services may incur fees. If you encounter a service that charges a fee, you will have the opportunity to review and accept these charges before proceeding. Please note that all our fees are quoted in Canadian Dollars and are subject to change.

Any modifications to our fee policy will be communicated through an announcement on our website. We reserve the right to adjust our fees, either temporarily or permanently, for promotional events or the introduction of new services. These changes become effective immediately upon their announcement.

All fees associated with our Website Services are non-refundable. It is crucial to ensure timely payments to avoid any limitations or disruptions in your use of the Website Services. In the event of payment method failure or overdue accounts, we may implement collection mechanisms to recover any outstanding fees.

Applicable Canadian taxes related to our services will be collected as required by law. Accurate address information is necessary for tax compliance purposes. You are also responsible for collecting and remitting any applicable taxes resulting from the sale of your services or items listed on Comforhome.

Most features of the Website Services are accessible across all Comforhome websites and associated mobile applications. However, there may be variations in specific features and functionalities depending on the website or mobile device used to access our services.

To access certain functionalities on our website, you must be a resident of Canada and legally capable of entering into a binding contract as per applicable law. This includes meeting the legal age requirement in your respective Province or Territory. Additional requirements may be outlined in Comforhome’s other policies.

By using Comforhome, you agree to comply with all relevant laws and regulations, including but not limited to licensing and insurance requirements, for any transactions you conduct on our platform. This ensures a safe and legal environment for all users involved in buying or selling services or items.

Responsibility and Liability

As a third-party service provider engaged with the Comforhome platform, you acknowledge and agree that you bear full responsibility and liability for all services that you offer and provide to clients. This includes, but is not limited to, the quality, safety, legality, and delivery of the services. You are responsible for ensuring that your services comply with all applicable local, regional, and national laws, regulations, and professional standards. In the event of any dispute, claim, loss, injury, or damage arising from or in connection with the services you provide, you agree to assume all responsibility and liability.

Comforhome operates as a facilitator, providing an online platform that connects you, the service provider, with potential clients. Our role is strictly limited to this facilitation, and as such, Comforhome is not involved in and is not responsible for any aspect of the services you provide. This includes, but is not limited to:

  • The actual conduct of the services.
  • The interaction between you and the clients.
  • The outcomes or results of the services rendered.
  • The verification, validation, or quality assurance of your services.

Comforhome does not endorse, certify, or guarantee the qualifications, expertise, or quality of the services provided by you or any other service providers on the platform. Clients select services at their own risk, and Comforhome disclaims all liability in this regard.

To the fullest extent permitted by law, Comforhome, including its directors, employees, agents, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your provision of services; (b) your access to, use of, or inability to use the Comforhome platform; (c) any conduct or content of any third party on the Comforhome platform, including without limitation, any defamatory, offensive, or illegal conduct; or (d) unauthorized access, use, or alteration of your transmissions or content.

You agree to indemnify and hold harmless Comforhome and its affiliates, officers, agents, and employees from any claim, suit, or action arising from or related to the use of the Comforhome platform or violation of these Terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.

Content Guidelines and Intellectual Property Rights

As a service provider on Comforhome, it is imperative that you ensure all content you post does not infringe upon the rights of third parties. This encompasses respecting intellectual property rights, including but not limited to, copyright and trademarks. You are responsible for ensuring that your content is either original or that you have secured the necessary rights or permissions for its use.

If your content includes any references or likenesses of identifiable third parties, you are required to obtain and be able to demonstrate consent from each individual, as applicable. This is essential to protect the privacy and rights of these individuals and to align with legal standards.

Be advised that Comforhome reserves the right to remove any content from our platform if there is a reason to believe that it violates these terms, our policies, or infringes on any party’s rights. As a service provider, you are expected to adhere to these guidelines to maintain the integrity and legality of your offerings on our platform.

All intellectual property rights related to the Comforhome website and its contents, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Comforhome and its licensors. This includes any modifications, adaptations, translations, or derivative works made from Comforhome content. Unauthorized use, reproduction, or distribution of any material from the Comforhome website without express permission infringes upon our intellectual property rights and is strictly prohibited. As a user, you acknowledge and agree to respect these rights and use the website content in compliance with the applicable laws and terms of use.

Disclaimer of Warranties

You acknowledge and agree that the use of Comforhome’s Website Services, including all content, functions, materials, and information available on or accessed through our platform, is provided on an “as is” and “as available” basis. Comforhome and its affiliates, to the fullest extent permissible by law, make no representations or warranties of any kind, express or implied, as to the operation of the Website Services, or the information, content, materials, or products included on our platform.

Comforhome expressly disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. This means that Comforhome does not warrant that the Website Services, its servers, or email sent from Comforhome are free of viruses or other harmful components. Furthermore, Comforhome does not guarantee or warrant that the use of our Website Services will be uninterrupted, timely, secure, or error-free, nor does Comforhome make any warranty as to the results that may be obtained from the use of the Website Services.

Any material downloaded or otherwise obtained through the use of the Website Services is done at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. Comforhome does not endorse, warrant, or assume responsibility for any product or service advertised or offered by a third party through the Website Services or any hyperlinked website or featured in any banner or other advertising. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

General

As a service provider on Comforhome, please understand that these terms, along with our other posted policies on the Website Services, constitute the entire agreement between you and Comforhome, superseding any prior agreements. This agreement is governed by the laws of the Province of Ontario and the applicable federal laws of Canada, and both you and Comforhome agree to submit to the jurisdiction of the courts in the Province of Ontario. The non-enforcement of any provision of these terms by us does not constitute a waiver of our right to enforce it at a later time. Should any provision of these terms be struck down by a court, the remaining terms will remain in effect. Comforhome reserves the right to assign this agreement at our discretion, as per the notice provision stated below, with no notice required for assignment to an affiliate. For all matters except those related to illegal or infringing content, your notices to us must be sent by registered mail to our designated address, ensuring formal and documented communication. We reserve the right to update this agreement at any time. The updates will become effective when you next use the site or after 30 days, whichever comes first.
